. joe johns has a look. >> randi, after weeks of speculation the court decided to take up two cases on same-sex marriage. the first one about the defensive marriage act. windsor against the united states. they were married in toronto, canada, in 2007. spire died in 2007 in new york at a time when new york recognized same-sex marriages that were performed outside the state. she was required to pay $363,000 on federal estate taxes on her inheritance that she would not have had to pay that opposite marriages get. so, a pretty clean case here and even the obama administration has already said it doesn't think the constitutionality of the defensive marriage act can withstand a legal attack. the second case the court decided to take on is proposition 8, the california ballot initiative adding a state constitutional amendment in 2008 that said only marriage between a man or woman is valid or recognized in california. it overturned a court ruling that said same-sex couples have a right to marry. the cases are likely to be heard in march and decided some time in june. randi? >> joe johns, th

trying to get some leverage to go against john boehner? are there people who are really angry enough or convinced enough that they can't vote for this? >> i think what it reflects is populous pressure coming from the tea party movement. tea party movement is widely, i think, misunderstood by democrats as anti-tax or some other reason of the movement. it's an anti-government spending and government over-reach move m, which is very different from grover nor cyst project of holding the line on taxes. john boehner is a guy in 2010 who was asked what part of government would you cut, he's like, i don't know. he didn't have an answer. republicans have stopped having that answer traditionally. the tea party movement rose up to challenge that finally and put pressure on that. it's a real pressure, but they don't have leadership in the house right now that reflects that. they didn't get leadership that reflected that in the presidential race. that wasn't where mitt romney was coming from. there was a dissatisfaction there but they don't have a leader yet. i think what we will see is whatever

johns has been following both cases for us. joe, explain the impact of today's decision. >> well, it is big impact. as you know, this is one of those cases that people talk about over the water cooler. let's start with proposition 8. very simple, wolf, it is the california ballot initiative passed in 2008 by the people of the state of california that established marriage as between a man and a woman. it overturned a court case that said same sex couples have the right to marry. windsor is the other case you were talking about, it is an attack on defense of marriage act which was passed in 1996 by the congress, signed by the president. it's called windsor against the united states. it is about a woman named edith windsor who had a long time relationship with her partner, and they were married in 2007. spier died in new york in 2009, and edith windsor got a lot of money. something like $363,000 as a result of that, she was required to pay that in federal estate taxes on her inheritance. she would not have had to pay that money if federal law had given that same sex relationship the

with raising tax rates. but at the end of the day, it only matters what john boehner can get the house republicans to accept. last week the speaker indicated he might be okay with raising rates, he backtracked a few hours later. what's the appetite right now for raising those rates? is that something that's going to be an easier sell for john boehner than a lot of folks think? >> i don't necessarily think so. i think until we see guys like say jason chafitz of utah or tim scott of south carolina start speaking out about the possibility of extending taxes for the middle class and going up, i don't think it can happen, necessarily. you know, and they run the risk potentially of running into a situation like we did in 2008. where a deal is put together on t.a.r.p. back then remember it was voted on, voted down, they had to go back and do it again. that if the speaker is not careful and doesn't keep his caucus in the loop, they could potentially turn around and say no, this isn't what we wanted. you never consulted us, anyway, why would we vote for something like this? a lot of them could

to get a deal with the house speaker john boehner over taxes and spending cuts. our chief political analyst gloria borger is here to take a closer look at the agreements, the disagreements, i guess there's more disagreements than agreements. let's step back and see where these two sides stand, gloria. >> let's step back from the cliff here for a minute, wolf. and you'll see that on tax, which is of course the crux of this matter, there's a huge difference between congressional republicans who want to raise $800 billion over ten years from tax increases. and of course the white house that wants to, you know, basically double that. i mean, the white house says, we need to get more revenue from taxes. if you break apart these tax number, take a look, because of course we know, the big issue, the theological issue here, wolf, is raising rates. the white house says let's raise them back to bill clinton's days. and the republicans of course say, no way, let's not raise those rates. here's what's really interesting to me, though. both sides say in the future they want to do the same thing.
